USCIS Updates Guidance on Determining Custody for Children Acquiring U.S. Citizenship

 U.S. Citizenship and Immigration and Services is issuing guidance regarding the legal and physical custody requirements for purposes of acquisition of U.S. citizenship under section 320 and naturalization under section 322 of the Immigration and Nationality Act (INA). We are also expanding guidance on derivation of citizenship before the Child Citizenship Act of 2000, under former INA section 321.

The update clarifies and expands the current guidance on determining legal and physical custody of children of U.S. citizens for acquisition of citizenship purposes. Specifically, the updated guidance:

  • Expands guidance on when USCIS considers a child to be in the legal custody of the U.S. citizen parent, clarifies the effect of a nunc pro tunc (retroactive) correction of a custody order, and clarifies when USCIS may recognize private custody agreements;
  • Clarifies that USCIS considers a U.S. citizen parent who has actual uncontested custody of a child to have legal custody for purposes of acquisition of citizenship when there is no judicial determination on legal custody and the relevant jurisdiction’s law does not determine which parent has legal custody of the child;
  • Provides that a U.S. citizen parent has physical custody of a child when the child resides or physically lives with the parent;
  • Expands guidance on adjudicating derivation of U.S. citizenship claims before the Child Citizenship Act of 2000, by providing detailed clarification on each of the requirements of former INA section 321, including the legal custody requirements; and
  • Clarifies that USCIS cannot issue a Certificate of Citizenship to any applicant who does not take the Oath of Allegiance and is not eligible for a waiver of the oath.

This guidance is effective immediately and applies to applications pending on or after Nov. 19, 2024. For more information, see Volume 12, Part H of the USCIS Policy Manual.

This update will help ensure consistent determinations of legal and physical custody for adjudication of citizenship claims and provide more detailed guidance on how to determine legal and physical custody for eligibility for a certificate of citizenship in these cases. 

USCIS is also implementing these changes consistent with Executive Order 14012, Restoring Faith in Our Legal Immigration Systems and Strengthening Integration and Inclusion Efforts for New Americans, and the goals of removing barriers to citizenship.

Cap Reached for Additional Returning Worker H-2B Visas for the First Half of FY 2024

 U.S. Citizenship and Immigration Services has received enough petitions to reach the cap for the additional 20,716 H-2B visas made available for returning workers for the first half of fiscal year 2024 with start dates on or before March 31, 2024, under the H-2B supplemental cap temporary final rule (FY 2024 TFR). Jan.9, 2024, was the final receipt date for petitions requesting supplemental H-2B visas under the FY 2024 first half returning worker allocation.

We are still accepting petitions for H-2B nonimmigrant workers with start dates on or before March 31, 2024, for the additional 20,000 visas allotted for nationals of El Salvador, Guatemala, Honduras, Haiti, Colombia, Ecuador, and Costa Rica (country-specific allocation), as well as those who are exempt from the congressionally mandated cap, as well as those who are exempt from the congressionally mandated cap.

The FY 2024 TFR was published on Nov. 17, 2023, with an immediate effective date. USCIS immediately began accepting H-2B petitions with start dates on or before March 31, 2024, for the 20,716 returning worker allocation for the first half of FY2024, and the 20,000 allocation for nationals of El Salvador, Guatemala, Honduras, Haiti, Colombia, Ecuador, and Costa Rica who are exempt from the returning worker requirement.

Petitioners with start dates on or before March 31, 2024, whose workers were not accepted for the 20,716 returning worker allocation are encouraged to file under the country-specific allocation while visas remain available. As of Jan. 12, 2024, USCIS has received petitions requesting 4,500 workers under the 20,000 visas set aside for nationals of El Salvador, Guatemala, Honduras, Haiti, Colombia, Ecuador, and Costa Rica.

USCIS Changes Filing Location for Form I-907 With Form I-140 (USCIS cambia el lugar de presentación del formulario I-907 con el formulario I-140)

 U.S. Citizenship and Immigration Services will begin transitioning the filing location for Form I-907, Request for Premium Processing, when filed with Form I-140, Immigrant Petition for Alien Workers, from the service centers to the USCIS lockbox on Nov. 13.

On Nov. 13, the filing location for newly filed Forms I-140 filed at the same time with Form I-907 will change from the USCIS service centers to the USCIS lockbox as part of our efforts to increase efficiency by reducing our footprint at the service centers, digitizing the process, and reducing costs.

This change in filing location does not apply if you are filing Form I-907 for a currently pending Form I-140, or if you are filing Form I-140 with an associated application (such as Form I-765, Form I-131, or Form I-485). We will soon announce filing location changes for these forms, but at this time, they should be filed with the service centers, as listed on the Direct Filing Addresses for Form I-140, Immigrant Petition for Alien Worker page.

At this time, the lockboxes will reject any Form I-907 filed with a Form I-140 that has an associated Form I-131, Form I-485, or Form I-765. These types of Form I-907 requests should continue to be filed with service centers as listed on the Direct Filing Addresses for Form I-140, Immigrant Petition for Alien Worker page.

Starting Nov. 13, please use the following addresses when mailing Form I-140 and Form I-907 together to USCIS. Starting Dec. 13, USCIS will reject any Form I-907 filed with Form I-140 that is received at the previous service center address.

USCIS Updates Guidance for Special Immigrant Juvenile Petitions (USCIS actualiza la guía para peticiones especiales de inmigrantes juveniles)

 Con vigencia inmediata, estamos actualizando la guía en el Manual de Políticas de USCIS (PDF, 343.18 KB) para adjudicar peticiones de Inmigrantes Especiales Juveniles (SIJ). Esta actualización hará que el proceso de adjudicación SIJ sea más eficiente para algunos solicitantes.

Estamos actualizando esta guía para alinearla con la orden declarativa del 31 de julio de 2023 en Casa Libre/Freedom House contra Mayorkas . El plazo de 180 días para que USCIS resuelva una petición SIJ se aplica sólo a la adjudicación inicial de una petición SIJ. No se extiende a la adjudicación de ninguna moción o apelación presentada después de una denegación de una petición SIJ.

SIJ es una clasificación de inmigración para no ciudadanos en los Estados Unidos que necesitan la protección de un tribunal de menores porque han sido abusados, abandonados o descuidados por uno de sus padres. Pueden solicitar la clasificación SIJ utilizando el Formulario I-360, Petición de amerasiático, viudo(a) o inmigrante especial . Los no ciudadanos con clasificación SIJ pueden calificar para el estatus de residente permanente legal (también conocido como obtención de una Tarjeta Verde).
