How to Manage Your U.S. Investment Assets and Company from Abroad: Know Your Duties, Rights, and Legal Risks

Living outside the United States does not exempt you from your U.S. tax responsibilities. Many foreign investors mistakenly believe that once they leave the country or are considered non-residents, they no longer have to file or pay taxes on income earned in the U.S. Nothing could be further from the truth.

Under Title 26 of the Internal Revenue Code (IRC), any income generated within the United States — whether from investments, real estate, dividends, or capital gains — is subject to IRS taxation, even if the owner resides abroad.

⚖️ Non-Resident Foreigners’ Obligations under the IRS

According to IRC §§ 871 and 882, foreign non-residents must declare income derived from U.S. sources, including:

  • Rental income from U.S. real estate (Form 1040-NR for individuals, Form 1120-F for foreign corporations).

  • Dividends or interest from U.S. entities.

  • Gains from the sale of U.S. property or investments.

  • Business activities conducted in the U.S., even through agents or representatives.

Additionally, the Foreign Investment in Real Property Tax Act (FIRPTA – §897) requires a 15% withholding of the gross sales price whenever a foreign person sells a U.S. property.

Failure to comply with these provisions may result in:

  • Penalties exceeding 25% of the undeclared income.

  • Accrued interest from the original due date.

  • In severe cases, criminal prosecution under IRC §7201 (Tax Evasion), which can lead to imprisonment and asset forfeiture.

馃寪 Why Not Every “Tax Preparer” Is the Same

Anyone can fill out a tax form — but only a Professional Accountant and Authorized Tax Preparer under IRS Circular 230 can legally represent you before the IRS and ensure your tax planning follows the Code of Federal Regulations (26 CFR §601.502).

At Two Hundred Global Financial Solutions, we invest year-round in continuing education, attend IRS-approved seminars and national conventions, and renew our credentials annually as Enrolled Agents, Certified Acceptance Agents (CAA), Public Accountants (PA), and MBA-qualified professionals.

This ongoing commitment to professional excellence guarantees our clients accuracy, compliance, and peace of mind.

⚠️ What Happens If You Ignore Your U.S. Tax Duties

If you are a foreign national and plan to return to the U.S. someday — even with a simple tourist visa — unpaid tax obligations can affect your re-entry or visa eligibility.
Under IRC §7345, the U.S. government can revoke or deny passports for individuals with significant tax debts.

Additionally, unresolved IRS or state liabilities may negatively impact future E-2 investor, EB-5, or permanent residency visa applications. In short: leaving the country does not erase your tax history.
